FLEECEHOLD – What does it mean for Oak Tree Gardens?

Fleecehold

You may have seen the term “fleecehold” used increasingly in relation to modern private freehold housing developments.

It is generally used to describe situations where homeowners own their properties freehold, but are still required to pay ongoing private estate management charges for shared areas such as open spaces, landscaping, drainage and other estate infrastructure.

The concern is not simply that homeowners have to contribute towards maintenance. Shared areas need to be maintained and paid for. The wider concern is how these arrangements can operate.

On many developments, homeowners can find themselves paying full Council Tax while also funding private maintenance of parts of their estate. They may have little influence over the managing agent or contractors, limited ability to challenge costs, and charges which can increase over time. Buyers may also not fully appreciate the extent of these obligations when purchasing their home.

Oak Tree Gardens has experienced some of these issues, particularly during the period when the Management Company remained under developer control. Residents were required to fund the estate while having very limited influence over how the Management Company operated, which contractors were appointed or how money was being spent.

However, there is an important distinction at Oak Tree Gardens today.

Since January 2026, the Management Company has been controlled by resident-appointed directors. This means residents now have direct oversight of the budget, contracts, managing agent and how service charge money is spent. We have already used that control to challenge costs, retender services, improve transparency and reduce expenditure.

That does not mean the wider issues associated with private freehold estates have disappeared.

Residents still pay for the upkeep of privately managed areas alongside Council Tax. We still need to ensure management charges remain reasonable, transparent and properly controlled. There are also wider questions around the long-term ownership and maintenance of open space, SuDS and other infrastructure which affect many modern housing developments.

Oak Tree Gardens therefore provides a useful example of both sides of the issue: the problems homeowners can face when they have little control over a private estate management arrangement, and the difference resident control of the Management Company can make.

Our view is that freehold homeowners should have proper transparency, accountability and meaningful control over the costs they are required to pay. Where residents are funding the management of their own estate, they should have a genuine say in how that money is spent.
